Fiduciary Services

We provide financial and/or personal oversight, support and advocacy to vulnerable populations that are unable to care for themselves, ranging from informal stewardship to court appointment.  Professional fiduciaries provide critical services to seniors, persons with disabilities, and children. We manage matters for clients including daily care, housing and medical needs, and also offer financial management services ranging from basic bill paying to estate and investment management.

Personal & Financial Oversight & Management

Agent under Power of Attorney (POA)
​

Once someone can no longer make suitable decisions for themselves, a POA can be an appropriate next step without involving the courts. 

A POA is a legal document giving one person the power to act for another. It can grant broad or limited legal authority based on need, and relates to property, finances or medical care.
​

As fiduciaries, substituted decision making based on the client's expressed wishes and desires is used in conjunction with the authority granted by the POA.  This allows us to identify and advocate for their goals, needs and preferences.

Conservator/Guardian, Trustee/Estate Executor
​

A fiduciary can be appointed to act as a ​Conservator of the Person and/or Conservator of the Estate, Guardian, Trustee or Executor.

A Conservatorship can be put in place if an  individual is deemed by the court to be physically or mentally incapacitated. 

A Conservator of the Person is appointed by the court to assume responsibility for decisions regarding the health and welfare of a person. 

​ A Conservator of the Estate​ is responsible for the prudent use and protection of a person's assets.  

A Guardianship refers to the court appointed personal and financial care of a minor. ​

​​A Trustee is responsible for carrying out the terms of the trust document. A trust can be created by the language found in a will or a document created during life. 
​
An Executor has the duty to inventory and safeguard assets, collect income, verify and pay obligations, identify and notify heirs and beneficiaries, and distribute assets.
